CHANDIGARH: Chandigarh Beopar Mandal (CBM) forwards Memorandum to New Adviser to Administrator U T Chandigarh suggesting need based amendments in Building Byelaws related to commercial property in Chandigarh
Conversion from leasehold to Freehold of commercial Property, Apartment Act demanded apart from seeking other relief measures regarding commercial establishments.
Chandigarh Beopar Mandal forwarded a comprehensive memorandum to the new Adviser, Sh. Dharam Pal seeking need based rationalization of Building Byelaws at the earliest as per mentioned below:-
- Commercial and Industrial Property should allowed to be converted from leasehold to freehold upon reasonable charges. All new auctions of commercial property should be on freehold basis which has hitherto remained unsold in spite of best of efforts by Estate Office, Chandigarh Housing Board, Municipal Corporation, simply because it is not commercial viable for the new investors.
- Apartment Act should be implemented in the city both for Commercial and Residential property to give relief to small and medium traders so that they could buy portion of a building as per their requirement.
- Permission of General trade should be permitted on the upper floors of all Commercial buildings without any conversion charges.
- Construction of First Floor on single storey Booths and Bay Shops should be permitted for storage purpose to support small businesses.
- Penalty for Violation/Misuse should be rolled back to original Rs.10/-per Sq. Ft. per month from hefty manifold increase done in the year 2007 that also retrospectively without the consent of the competent authorities i.e. Parliament of India.
- Transfer of allotted leasehold property should be done without charging one third of unearned profit.
- Conversion charges from SCF to SCO which have been increased from Rs.5 Lac to Rs.60 Lac on V-4 road sector Markets should be rationalized
- Box type construction of SCO and SCF in first phase sectors should be permitted on the pattern of second and third phase sectors.
This memorandum is being forwarded to the Adviser with an appeal to be taken on priority and Chandigarh Beopar Mandal offers for any extensive deliberation with all concerned departments if there is a need for the same.
